Default do canadian wireless carries legally have to tell you almost over your data

Apparently Fido has gotten rid of their text messages informing you of 75% data usage and 100% data usage.. is this even legal? The rep on the phone told me it's my responsibility to check their My Account app for usage.. even though it's 4 hours delayed :S
